2. LICENSE AGREEMENT
The digital products, including any product packaging (“Packaging”), that accompanies this License Agreement (collectively the “Product”) is the property of WorkDigital and is protected by copyright law. Although WorkDigital continues to own the Software, after Your acceptance of this Agreement You will have certain rights to use the software, listed below. WorkDigital grants You a nonexclusive limited license to use the Products sold through our web site in accordance with this License Agreement (the "license") issued by WorkDigital.
a) MODIFICATIONS
You are not authorized to make any modification(s) to the Product.
b) UNAUTHORIZED USE
You may not place any of our products on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from WorkDigital.
c) ASSIGNABILITY
You may not sub-license, assign, or transfer this license to anyone else without prior written consent from WorkDigital.
d) OWNERSHIP
You may not claim intellectual or exclusive ownership to any of our Products. All ownership rights in the Products remain the property of WorkDigital.
3. LIMITED WARRANTY
WorkDigital warrants that the Product will be free from defects for a period of three (3) days from the date of delivery of the Product to you or from the date of download. Your sole remedy in the event of a breach of this warranty will be that WorkDigital will, at its option, replace any defective Product returned to WorkDigital within the warranty period or refund the money you paid for the Software. WorkDigital does not warrant that the Product will meet Your requirements or that operation of the Product will be uninterrupted or that the Software will be error-free.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE ABOVE WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE AND COUNTRY TO COUNTRY.
4. REFUND POLICY
Since WorkDigital offers non-tangible, irrevocable goods we do not issue Product refunds after a website has been created, customized and / or after the customer has accessed the product online. The deadline for any refund claim (less shipping charges) on a tangible, shipped product is three (3) days after the delivery date. The refund is issued to you after WorkDigital confirms that the Product and any Packaging have been returned. NO REFUNDS ON ANY Application Fee(s).
5. WorkDigital’s OBLIGATIONS
WorkDigital agrees to create a website, customize a website, or grant customer access to downloadable files based on the products and specifications contained within the customer's order. WorkDigital’s full performance of all obligations associated with the purchase of any Product is complete upon your first access to the Product online, by use of your personal access code.
WorkDigital reserves the right to change or modify these terms with no prior notice.
